In this post-hearing interview, attorney Wade H. Eldridge discusses a case he successfully defended and was dismissed earlier that morning. Our client was a passenger in a vehicle stopped for a “smoked” license plate cover, C.R.S 42-3-202 (2)(b) —a statute that applies only when a plate is unreadable by an automated scanner. During the stop, the officer quickly shifted into investigative questioning unrelated to the traffic mission and called for a K-9 unit within two minutes. Nineteen minutes later, before the driver had been cited or released, officers removed all occupants from the vehicle, deployed a narcotics dog, and conducted a search that led to charges against our client for violating a protection order and possessing an illegal weapon. At the suppression hearing, we raised three defenses: lack of reasonable suspicion for the initial stop, lack of probable cause based on concerns with the canine’s training and certification, and unlawful prolongation under Rodriguez. The Court dismissed the case on the first ground, ruling that the officer failed to articulate how the license-plate cover made the plate unreadable by a machine as required by the specific statute he relied on. Because the State could not cure that deficiency, all evidence was suppressed, and the case was dismissed. This interview captures Mr. Eldridge’s reaction and insights outside the courthouse moments after the ruling.
